General terms and conditions
The terms of business are governed by the Consumer Protection Act, the Electronic Commerce
Act, the Obligations Act, and other applicable regulations of the Republic of Croatia.
The Merchant reserves the right to modify the Terms and Conditions at any time. All changes
will be published on the Merchant's website and will take effect at the time of publication on the
website. Any changes to the Terms will apply to purchases made after such changes have been
published.
The Buyer is obliged to check the current Terms before each purchase.
Prior to making a purchase, the buyer declares in the application that they have read these
General Terms and accept them, and the same will be delivered to the Buyer as content or an
attachment to the email confirming that the contract has been concluded.
These Terms are available to users of services at any time, allowing them to save, reuse, and.
reproduce them..
These Terms and Conditions are considered an integral part of every Purchase Agreement
concluded between the Merchant and the Buyer via the online store.
The Merchant, through sales via the online store www.visageconceptstore.eu, acts on its own
behalf.
The Merchant incurs no additional costs for remote communication.
Products cannot be purchased outside the borders of the Republic of Croatia.
**Buyer**
The buyer of the product is any natural person who purchases products through the online store
in the manner regulated by these General Terms of Business, i.e., who selects at least one
product, places it in the cart, chooses cash on delivery as the payment method, and sends the
order to the Merchant.
The Buyer can only be an adult and legally competent person. A contract on behalf of and for
the account of a minor and completely legally incompetent person can be concluded by their
legal representatives or guardians. Persons with partial legal competence may only conclude a
contract with the consent of their legal representative or guardian. The Merchant assumes no
responsibility for actions contrary to this provision.
**Prices**
Through the online store www.visageconceptstore.eu, the buyer is enabled to purchase part of the product assortment available on the Merchant's website. All prices represent retail prices and are expressed in euros (EUR), including VAT, and apply to all payment methods at the time of purchase. The listed retail prices apply exclusively to the purchase of products via the online store and may differ from retail prices in physical stores. Retail prices apply under the payment methods and conditions listed below. The stated retail prices are valid at the time the order is received. Promotional offers are valid only at the time of ordering and may change without prior notice.
**Images and Product Information**
Images and descriptions may not necessarily match the product exactly. The Merchant reserves
the right to make errors in the description and images of products. Variations in color and
material that are common in the market remain reserved. Similarly, common variations in
buckles (e.g., decoration) and slight deviations in the execution of materials compared to
samples, especially concerning color tone, are reserved, as the samples or models are shown
to the buyer for informational purposes only and to approximate the characteristics of the goods,
without guaranteeing equality.
The Merchant is committed to ensuring, to the greatest extent possible, the accuracy and
up-to-dateness of the information on the website, especially regarding the prices of the offered
products and services. The Merchant is responsible for any errors in the product description,
images, or errors that occur during price changes and website updates.
In the event of such an error, especially if the price displayed on the website for any reason
does not correspond to the actual product price, the Merchant will promptly notify the Buyer of
the same and allow them to cancel or modify the order.
If the buyer decides to cancel the product order, the Merchant will refund the paid amount as
soon as possible, but no later than 14 days from the date the Buyer was notified of the order
cancellation.
**User Registration and Product Orders**
Products are ordered electronically, and they can be ordered by both registered users and
guests. Registration is done by creating a user account, which is free of charge. During
registration, the user creates a username and password. The user is responsible for all actions
and orders made under their username. The registered user/buyer is responsible for the
accuracy and completeness of the information provided during registration and purchase.
Products are ordered through the shopping cart. When the Buyer places an order, the contract
is concluded, and the Merchant will immediately notify the Buyer by email that the contract has
been concluded by sending an Order Confirmation via email. The Order Confirmation contains
information about the order, delivery address, payment method, price(s), contact details of the
Merchant's customer service, and other information in accordance with the law. Along with the
order confirmation, the Buyer will receive the General Terms of Business of the online store and
a Notice of the right to unilateral termination of the contract, which includes a Form for the right
to unilateral termination of the contract. By accepting these Terms, the Buyer expressly agrees
that the General Terms of Business and the Notice of the right to unilateral termination, which
includes the Form for the right to unilateral termination of the Contract, will be delivered
electronically via email.
After sending the order confirmation, the Buyer can modify the order only by contacting
Customer Service at the email: info@visageconceptstore.eu.
On the webshop, the Buyer can pay for their order by clicking on "Buy." In the shopping cart, the
total purchase amount will be displayed (including the costs of additional services: delivery and
VAT).
The Merchant will deliver the products to the Buyer in the ordered quantity if they are available.
If the Merchant is unable to deliver a specific product within the expected time due to the
product being out of stock or no longer available from the supplier, the Merchant will notify the
Buyer in writing by sending a Delay Notification via email. The Buyer may cancel the order or
accept the new delivery time.
If the buyer decides to cancel the product order, the Merchant will refund the paid amount as
soon as possible, but no later than 14 days from the date of the delay.
**Delivery/Collection of Goods**
The cost of delivery is not included in the price of the product. The delivery cost is charged at
€5.00, including VAT.
Once the goods are ready for delivery or collection, the Merchant will notify the Buyer via email
that the goods are ready for dispatch.
The delivery of the purchased product is made to the delivery address provided when the order
was placed.
Product delivery to the Buyer is done only on weekdays during the delivery service's working
hours.
If any of the ordered products are missing, the Merchant will deliver them later, free of charge, in
the shortest possible time.
The delivery time for available products in the online store is between 3 and 14 business days
unless the Buyer has been notified of a different delivery time.
The delivery period begins after the order has been received, or after the Buyer receives
confirmation that their order has been received.
Saturdays, Sundays, holidays, and non-working days are not counted in the delivery time.
If the Buyer refuses to accept the correct and undamaged goods they ordered, the Merchant
has the right to deduct from the purchase price the amount of the direct costs related to delivery
**Payment**
The buyer can pay for ordered products and services using one of the following methods:
1) Cash on delivery
2) Bank transfer to IBAN
3) Debit and credit cards
**Payment Security**
The safest payment method is cash on delivery because you pay the courier when the package is handed over to you.
**Liability for Material Defects of Products**
The Merchant is responsible for any material defects of the items sold on its website in accordance with applicable laws, particularly the Obligations Act of the Republic of Croatia and the Consumer Protection Act.
**Complaints**
Complaints should be submitted via email to: info@visageconceptstore.com
The email should include the subject "COMPLAINT FOR ORDER (order number)."
Ordered products are packed in a way that prevents damage during normal handling during
transport/delivery.
If the shipment is visibly damaged during transport, the Buyer is not obliged to accept the package.
If the defects are caused by improper delivery, storage, or other improper actions by the buyer,
the buyer bears no responsibility.
The right to file a complaint will be handled according to the Consumer Protection Act and the
Obligations Act.
**Order Cancellation and Contract Termination**
The buyer may cancel an order at any time before the product is delivered by sending a
cancellation statement via email to info@visageconceptstore.eu.
If the order is canceled before the products leave the Merchant’s warehouse, the buyer is
entitled to a refund of the full amount paid for the products and any additional services.
After the order is canceled, the Buyer will receive a Cancellation Confirmation via email.
**Right of Withdrawal under Section IV, Article 72 of the Consumer Protection Act**
The buyer has the right to withdraw from a contract made outside of business premises or at a
distance within 14 days without providing any reasons.
This period begins on the day the buyer, or a third party designated by the buyer (other than the
carrier), takes possession of the goods covered by the contract.
If a single order contains multiple items to be delivered separately, or if goods are delivered in
multiple parts or shipments, the period begins on the day the buyer, or a third party designated
by the buyer (other than the carrier), takes possession of the last item or shipment.
If the Seller does not inform the Buyer of their right to withdraw from the contract, this right
expires within 12 months from the end of the original withdrawal period (the 12-month period
begins after the 14-day withdrawal period that applies if the buyer was duly informed). If the
notice of the right to withdraw is provided within the 12-month period, the withdrawal right
expires 14 days after the Buyer receives this notice.
Before the withdrawal period expires, the buyer must notify the Merchant of their decision to
withdraw from the contract using the Withdrawal Form available here: (link to form) or through
any other clear statement expressing their intention to withdraw, sent via email to the Merchant:
info@visageconceptstore.eu.
The Buyer can electronically complete and submit the Withdrawal Form available on the
Merchant's website.
The Merchant is obligated to promptly send the consumer a confirmation of receipt of the
withdrawal notice via the email address provided in the Withdrawal Form or Statement of
Withdrawal.
The buyer must send the withdrawal notice before the withdrawal period expires.
The buyer is required to return the goods without delay and no later than 14 days from the day
they notified the Merchant of their decision to withdraw from the contract.
The buyer must bear the direct cost of returning the goods, which is €5 (37.67 HRK).
The Merchant is obligated to refund the full amount paid by the Buyer within 14 days of
receiving the written notice of contract termination.
The Merchant is not required to refund the payment before the returned goods are received by
the Merchant unless the Merchant has offered to collect the goods themselves or after the buyer
provides proof that they have sent the goods back to the Merchant, if such proof is provided
before the goods are received.
The Merchant is obligated to refund the payment using the same payment method used by the
Buyer, unless the Buyer explicitly agrees to another payment method, provided that the Buyer is
not required to pay any additional costs for such a refund.
In accordance with Article 77, Paragraph 5 of the Consumer Protection Act, the Buyer is
responsible for any reduction in the value of the purchased product resulting from handling,
except for handling necessary to establish the nature, characteristics, and functionality of the
goods.
Exclusion of the Right to Withdraw from the Contract
The buyer does not have the right to withdraw in cases specified in Article 79 of the Consumer
Protection Act, particularly if:
● The subject of the contract is goods or services whose price depends on fluctuations in
the financial market, which are beyond the control of the merchant and may occur during
the consumer’s right to unilaterally withdraw from the contract;
● The subject of the contract is goods made according to the consumer’s specifications or
clearly customized for the consumer.
Duration of the Contract
The contract between the Buyer and the Merchant is a one-time distance sales contract, which is fulfilled by the delivery of goods and the payment made by the buyer, unless it is terminated. These Terms of Purchase are an integral part of the contract.
Written Complaints by Buyers and Disputes
These General Terms are drafted in accordance with the Consumer Protection Act and other
regulations of the Republic of Croatia. Buyers can submit written complaints about the Seller's
products or services directly at the Seller's business premises or send them to the Seller's
address: Vodice, Kamila Pamukovića 38, by mail, fax, or email to: info@visageconceptstore.eu,
as specified in the Seller's contact information.
The Seller is obligated to confirm receipt of the Buyer’s written complaint without delay and
respond to it no later than 15 (fifteen) days from the day of receiving the written complaint.
In the case of a dispute between the Buyer and the Merchant, a complaint may be submitted to
the Honorary Court of the Croatian Chamber of Commerce, the Honorary Court of the Croatian
Chamber of Trades and Crafts, or a proposal for mediation at mediation centers.
In case of a dispute between the Buyer and the Merchant, efforts will be made to resolve the
problem through mutual agreement and peaceful means; otherwise, the competent court in
Zadar will have jurisdiction.
In accordance with Regulation No. 524/2013 of the European Parliament and the Council,
merchants involved in online sales contracts are required to provide an electronic link to the
platform for online resolution of consumer disputes on their websites. The platform for online
